These Terms of Service ("Terms") govern your access to and use of the Bid Discovery website at biddiscovery.com and the Bid Discovery service (the "Service") operated by Bid Discovery ("we," "us," or "our"). Please read these Terms carefully before using the Service.

1. Acceptance of Terms

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Bid Discovery provides an automated discovery and aggregation service for public bid opportunities, Requests for Proposals (RFPs), Requests for Qualifications (RFQs), and related procurement opportunities relevant to the architecture, engineering, landscape architecture, and planning industries.

Important: We aggregate opportunity information from publicly available sources. We do not guarantee the completeness, accuracy, timeliness, or availability of any opportunity listed on the Service. Opportunities may be outdated, modified, or withdrawn by their issuing agencies without notice to us. You should always verify opportunity details independently with the issuing agency before relying on them.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or abusive activity.

4. Subscription & Billing

The Service is offered as a paid subscription at $200 per month. New accounts receive a 14-day free trial to evaluate the Service.

5. Refund Policy

We may, at our sole discretion, offer pro-rated refunds in certain circumstances. After cancellation, no refunds will be issued for partial months of service remaining on your subscription. The free trial period is provided at no charge and does not qualify for refunds.

The Service aggregates bid and RFP opportunity data from publicly available sources including government procurement portals, agency websites, and public databases. We make reasonable efforts to provide accurate and timely information, but:

7. Intellectual Property

The Service, including its design, features, code, and content (excluding third-party opportunity data), is the intellectual property of Bid Discovery and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent.

You retain ownership of any data you submit to the Service (e.g., saved searches, preferences).

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BID DISCOVERY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOST PROFITS, LOSS OF BUSINESS, OR LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Indemnification

You agree to indemnify, defend, and hold harmless Bid Discovery and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any rights of a third party.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections relating to intellectual property, limitation of liability, indemnification, and governing law survive termination.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
